Terms of Service

1. Acceptance of Terms
By accessing or using the Tolinku platform, including our website at tolinku.com, the application at app.tolinku.com, our SDKs, APIs, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
If you do not agree with any part of these Terms, you must not access or use the Service.
2. Description of Service
Tolinku is a deep linking platform that provides the following capabilities:
- Universal Links (iOS) and App Links (Android) configuration and hosting
- Deferred deep linking for users who have not yet installed your application
- Click, install, and conversion analytics with geographic and device breakdowns
- Smart banners for mobile web-to-app promotion
- In-app messages and referral tracking
- A/B testing for deep link landing pages
- Webhook integrations for real-time event notifications
- SDKs for iOS, Android, React Native, Flutter, and Web platforms
- RESTful API for programmatic access
We may add, modify, or discontinue features of the Service at any time. We will provide reasonable notice for changes that materially affect your use of the Service.
3. Account Registration
To use most features of the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately if you become aware of any unauthorized use of your account.
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account. Each individual or legal entity may maintain only one account. We reserve the right to suspend or terminate accounts that we reasonably believe contain false or misleading information.
4. Appspaces and Usage
The Service is organized around "Appspaces," where each Appspace represents one application or project. Your subscription tier determines how many Appspaces you can create and what resources are available within each one.
- Each Appspace has its own set of routes, banners, analytics, team members, and configuration.
- Usage limits (clicks, API calls, routes, and other resources) apply per Appspace based on your subscription tier.
- You agree to use the Service in good faith. Artificial inflation of metrics (for example, using bots or scripts to generate fake clicks) is prohibited and may result in account suspension.
5. Subscription and Billing
5.1 Free Tier
Tolinku offers a free tier that is available indefinitely. No credit card is required to use the free tier. The free tier includes 1 Appspace, 5 routes, 1,200 clicks per month, 7-day analytics retention, 1 banner, 1 in-app message, 1 bio page, and 1 webhook.
5.2 Paid Plans
Paid plans (Standard, Growth, Scale, and Enterprise) are billed monthly or annually via Stripe. All prices are in US dollars unless otherwise stated. Paid plans include expanded limits, additional features, and longer analytics retention.
5.3 Free Trial
New accounts may be eligible for a 30-day free trial of Standard-tier features, which includes full platform access and up to 3 Appspaces. At the end of the trial, if you do not subscribe to a paid plan, your account will be downgraded to the free tier. No data will be deleted during the downgrade, but features and limits will be restricted.
5.4 Auto-Upgrade
If your usage exceeds the limits of your current subscription tier, your Appspace may be automatically upgraded to the next tier to ensure uninterrupted service. You will be notified via email when an auto-upgrade occurs. To prevent automatic upgrades, you can set a billing cap for each Appspace in your account settings.
5.5 Billing Cap
The billing cap feature allows you to set a maximum spending limit per Appspace. When a billing cap is active, your Appspace will not be auto-upgraded beyond the capped tier. If usage exceeds the capped tier's limits, excess traffic will be rate-limited rather than triggering an upgrade.
5.6 Refunds
Monthly subscriptions are non-refundable for partial months. Annual subscriptions may be refunded within 14 days of purchase. After 14 days, annual subscriptions are non-refundable. If you cancel a monthly subscription, you will retain access until the end of the current billing period.
5.7 Price Changes
We may adjust pricing for our plans from time to time. We will provide at least 30 days of advance notice before any price increase takes effect. Price changes will apply at the start of your next billing cycle following the notice period.
6. Acceptable Use
You agree not to use the Service to:
- Engage in or facilitate any illegal activity, including fraud, money laundering, or distribution of illegal content.
- Distribute malware, spyware, or phishing links through deep links or landing pages created on the platform.
- Attempt to circumvent usage limits, rate limiting, or access controls through technical means.
- Reverse-engineer, decompile, or disassemble any part of the platform (except as permitted by applicable open-source licenses).
- Abuse the API through excessive requests, scraping, or automated access beyond your plan's rate limits.
- Create deep links that perform deceptive redirects, cloaking, or misleading destination changes.
- Violate Apple's Universal Links guidelines or Google's App Links policies.
- Harass, threaten, or impersonate other users or third parties.
- Transmit content that infringes on the intellectual property rights of others.
We reserve the right to investigate and take appropriate action against violations, including account suspension or termination, removal of content, and reporting to law enforcement authorities.
7. SDK Terms
Tolinku provides software development kits (SDKs) for multiple platforms, including iOS, Android, React Native, Flutter, and Web. The following terms apply to your use of our SDKs:
- Our SDKs are provided under the MIT license (or the applicable open-source license specified in the SDK's repository). You may use, modify, and distribute the SDK code in accordance with that license.
- You are solely responsible for properly integrating the SDK into your applications and testing its behavior in your environment.
- If our SDK collects data from your end users (such as device identifiers, app events, or referral information), you must disclose this data collection in your application's privacy policy.
- You must comply with all applicable App Store (Apple) and Play Store (Google) guidelines when distributing applications that include our SDK.
- We provide the SDKs "as is" and do not guarantee compatibility with every application, operating system version, or device.
8. Intellectual Property
8.1 Our Property
Tolinku, its logos, branding, documentation, platform code (excluding open-source SDKs), and all related intellectual property are owned by Tolinku. You may not use our trademarks, service marks, or branding without prior written permission.
8.2 Your Content
You retain ownership of all content you create through the Service, including route configurations, landing page content, banner designs, and any custom HTML or media you upload. Designs created using our visual builder (when available) are your property.
8.3 License to Host
By uploading content to the Service, you grant Tolinku a non-exclusive, worldwide, royalty-free license to host, serve, cache, and display your content as necessary to provide the Service. This license terminates when you delete your content or close your account.
9. Data and Privacy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in our Privacy Policy.
- You are responsible for the data you collect from your own end users through applications that integrate with Tolinku.
- You must maintain appropriate privacy policies for your applications that accurately describe your data collection and sharing practices, including your use of Tolinku's deep linking and analytics services.
- Analytics data generated within your Appspace belongs to you and is accessible through your dashboard and API for the duration specified by your plan's retention period.
10. Webhooks and API
- Webhook delivery: webhook event delivery is provided on a best-effort basis with automatic retries for failed deliveries. We do not guarantee delivery of every webhook event, and you should design your systems to handle missed or duplicate events.
- API rate limits: API rate limits apply based on your subscription tier. Requests that exceed your rate limit will receive a 429 (Too Many Requests) response.
- Abuse and throttling: we reserve the right to throttle or temporarily suspend API access for accounts that exhibit abusive patterns, regardless of their rate limit allowance.
- API key security: Tolinku provides two types of API keys. Publishable keys (prefixed
tolk_pub_) are designed for client-side use in mobile apps and websites. Secret keys (prefixedtolk_sec_) grant full access to all endpoints and must be kept confidential; they must not be embedded in client-side code, committed to public repositories, or shared in documentation. You are responsible for keeping your secret keys secure and are liable for all API usage that occurs with your keys.
11. Uptime and Availability
We strive to maintain high availability of the Service, but we do not guarantee 100% uptime. The Service may be temporarily unavailable due to:
- Scheduled maintenance (announced at least 24 hours in advance when possible).
- Unplanned outages caused by infrastructure failures, security incidents, or other unforeseen events.
- Third-party service disruptions beyond our control.

12. Termination
12.1 Termination by You
You may cancel your account at any time through your account settings or by contacting us at [email protected]. Cancellation takes effect at the end of your current billing period.
12.2 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms or our Acceptable Use policy.
- Your account is used for illegal activity.
- You fail to pay applicable fees after notice and a reasonable cure period.
- We are required to do so by law.
We will make reasonable efforts to notify you before termination and allow you to export your data, except in cases of severe or repeated violations.
12.3 Effect of Termination
Upon termination, your data will be retained for 30 days to allow for data export. After 30 days, your data will be permanently deleted from our active systems. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will remain in effect.
13. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Tolinku's total aggregate liability for any claims arising from or related to your use of the Service is limited to the total fees you paid to Tolinku in the 12 months immediately preceding the event giving rise to the claim.
- Tolinku shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
- Tolinku is not liable for actions taken by third parties, including app store operators, end users of your applications, payment processors, or hosting providers.
- Tolinku is not liable for damages resulting from unauthorized access to your account caused by your failure to maintain adequate security of your credentials.
14. Indemnification
You agree to indemnify, defend, and hold harmless Tolinku, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising from or related to:
- Your use of the Service.
- Your content, including deep links, landing pages, and banner configurations.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Your infringement of any third-party intellectual property or privacy rights.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Provide at least 30 days of advance notice via email to the address associated with your account.
- Post the updated Terms on our website with a revised "Last updated" date.
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree with the modified Terms, you must stop using the Service before the changes take effect.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved as follows:
- Informal resolution: before filing any formal legal proceedings, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
- Jurisdiction: if informal resolution fails, disputes shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
17. Miscellaneous
- Severability: if any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
- Entire agreement: these Terms, together with our Privacy Policy and any applicable order forms or Enterprise agreements, constitute the entire agreement between you and Tolinku regarding the Service and supersede all prior agreements and understandings.
- No waiver: our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. A waiver of any provision is only effective if made in writing and signed by Tolinku.
- Assignment: Tolinku may assign its rights and obligations under these Terms to an affiliate or successor entity without your consent. You may not assign your rights or obligations under these Terms without our prior written consent.
- Force majeure: Tolinku shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or Internet disruptions.
